§ 10-53. Purpose.

  • The purpose of the board of construction adjustments and appeals shall be to:

    (1)

    Review and decide specific appeals made by individuals concerning the interpretation or administration of the county construction code which includes by reference the state minimum standard codes.

    (2)

    Review and decide specific appeals made by individuals concerning the interpretation or administration of the county fire prevention and protection code, the International Fire Code, and the National Fire Prevention Codes for every structure and occupancy constructed, with the exception of those buildings, structures and uses specified in O.C.G.A. § 25-2-12(a)(2). The uses specified in the subsection of the state fire safety law are hospitals, nursing homes, jails, ambulatory healthcare centers, penal institutions and any structure which is owned, operated or occupied by the state. Requests for variances or waivers concerning buildings, structures and uses specified in such subsection must be submitted in writing to the county fire marshal who shall make a written comment regarding the request and shall forward all documentation to the state fire marshal's office for a decision. The county fire marshal shall ensure that any applicant granted a variance by the state fire marshal is provided with a written response of the decision.

    (3)

    Advise the board of commissioners, the department of planning and development, and the department of fire and emergency services on issues and matters of concern regarding the codes described in this section.

    (4)

    Review and decide upon specific appeals of interpretation by the director and waiver requests from the stormwater requirements of articles VI, VII or VIII of the development regulations.
